Federal Appeals

Oklahoma Federal Appeals

Although the skills required for effective appellate advocacy in state courts are essentially the same as those needed in federal appeals courts, court-specific rules and procedural differences, and knowledge of judicial preferences and dispositions have an important role to play too.

At Seymour & Graham, we represent Oklahoma residents and business clients in civil and criminal appeals before the United States Court of Appeals for the Tenth Circuit. If you have recently received an unsatisfactory civil or criminal court decision and would like an experienced perspective of your chances for a reversal or modification of that decision on appeal — call us at 866.308.6532 or contact our firm online.

Handling Federal Appeals of
Civil and Criminal Court Decisions

Our attorneys are no strangers to the Tenth Circuit Court of Appeals and have demonstrated the ability to craft the kind of creative, authoritative arguments and compelling briefs that often result in success. Our federal appeals practice includes handling interlocutory appeals and those sought on various other grounds, including:

  • Mistakes or misconduct by opposing counsel or prosecutors
  • Wrongfully denied motions to suppress evidence
  • Wrongfully excluded evidence that should have been heard by the jury
  • Improper rulings on the evidence by the trial judge
  • Improper instructions to the jury
  • Ineffective assistance of counsel
  • Abuse of judicial discretion
  • Sentencing errors

Federal Writs

Although writs of habeas corpus are generally used to challenge the constitutionality of convictions in criminal defense cases, our lawyers can also use them in civil matters to challenge the validity of guardianships or child custody. Other writs we make use of in our federal appeals practice include writs of mandamus (used to force a specific court to take a particular action) and writs of prohibition (used to stop a specific court from taking a particular action).

In addition to handling Oklahoma federal court appeals, our lawyers also maintain a criminal appeals and civil appeals practice in northern Oklahoma state courts. Additionally, we are able to represent people in New Mexico.
