Oklahoma Criminal Appeals
In the criminal justice system, there are a number of rules, procedures and protocols in place to protect the rights of the accused and the integrity of the system as a whole. If these rules are not followed closely, the system fails to do its job.
At Seymour & Graham, we handle criminal appeals in northern Oklahoma appellate courts and in federal appellate courts statewide. If you have recently been convicted of a criminal offense and would like an experienced perspective of your chances for a new trial or reversal on appeal — call our law offices at 866.308.6532 or to contact us online.
Criminal Appeals in State Court
The first thing to be aware of with any type of appeal (criminal or otherwise) is that your right to appeal does not exist for an unlimited amount of time. To preserve that right, you must file a notice of appeal in timely fashion. If you would like our firm to represent and we agree to take up your cause, our attorneys will carefully review the facts and act quickly to file an appeal of your conviction on any appropriate grounds, including:
- Constitutional due process violations
- Ineffective assistance of criminal defense counsel
- Prosecutorial mistakes or misconduct
- Judicial abuse of discretion
- Wrongfully denied motions to suppress evidence
- Wrongfully excluded evidence that should have been heard by the jury
- Confessions obtained by fraud, coercion or other illegal means
- Sentencing errors
If the criminal appeals process in state court is unsuccessful, seeking relief through the federal appellate courts may be an option. For specific information on appealing decisions in federal criminal cases, and our federal writ practice — please review the Federal Appeals page of this Web site.
